1. Agreement to Terms

By accessing or using ShiftEase ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you do not have permission to access the Service.

2. Account Registration

To use ShiftEase, you must:

• Be at least 16 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3. Use of Service

You agree to use ShiftEase only for lawful purposes. You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Use the Service to harass, abuse, or harm others
• Collect or store personal data of other users without permission
• Use automated systems to access the Service without authorization

4. User Content

You retain ownership of any content you submit to ShiftEase (schedules, messages, etc.). By submitting content, you grant us a license to use, store, and display that content as necessary to provide the Service.

You are responsible for the content you post and must ensure you have the right to share it. We reserve the right to remove content that violates these terms.

5. Employer Responsibilities

If you are using ShiftEase as an employer, you agree to:

• Comply with all applicable labor laws and regulations
• Ensure accurate recording of employee hours
• Respect employee privacy rights
• Obtain necessary consent for location tracking
• Use the Service in accordance with your employment contracts

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Juan Jovel (ShiftEase) and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit permission.

7. Subscription and Payment

ShiftEase offers both free and paid subscription plans. By subscribing to a paid plan, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide accurate billing information
• Allow automatic renewal unless you cancel before the renewal date
• Understand that fees are non-refundable except as required by law

We reserve the right to modify pricing with 30 days' notice to existing subscribers.

8. Cancellation and Termination

Your Rights: You may cancel your account at any time through the app settings. Upon cancellation, your access will continue until the end of the current billing period.

Our Rights: We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or for any other reason at our discretion. We will provide notice when possible, but immediate termination may occur for serious violations.

9. Data and Privacy

Our collection and use of personal information is described in our Privacy Policy. By using ShiftEase, you consent to our data practices as outlined in that policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of any information

ShiftEase is a scheduling tool and does not provide legal, tax, or HR advice. You are responsible for ensuring compliance with applicable employment laws.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIFTEASE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless ShiftEase, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these terms.

13. Changes to Service

We reserve the right to modify or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

14. Changes to Terms

We may revise these terms at any time. We will notify you of significant changes via email or through the app. Continued use of ShiftEase after changes constitutes acceptance of the new terms. If you do not agree to the new terms, you must stop using the Service.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the Service shall be resolved in the courts of the United States.

16. Dispute Resolution

Any dispute arising from these terms or the Service will first be resolved through good-faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

17. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and ShiftEase regarding the use of the Service and supersede any prior agreements.
